These Terms of Service (“Terms”) govern your access to and use of Harve’s website, desktop application, and related services (the “Services”). By using the Services, you agree to these Terms. This is a working draft—please review with counsel before production use.

1. Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements we specify. You are responsible for the accuracy of information you provide.

2. Accounts

You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of unauthorized use.

3. The Services

Harve provides tools that may include screen activity capture, session review, and participation in data programs subject to in-product settings and disclosures. Features may change; we may suspend or discontinue parts of the Services with reasonable notice where practicable.

4. Your content and license

You retain rights to content you submit, subject to the license you grant us in product-specific terms (including rights needed to operate the Services, process payouts, and create datasets as disclosed). You represent you have the rights to grant such licenses.

5. Earnings and payouts

Earnings, thresholds, schedules, and taxes are described in the product and may depend on third-party processors (e.g., Stripe). We do not guarantee any minimum earnings.

6. Prohibited conduct

You agree not to misuse the Services, including attempting to circumvent controls, submit unlawful or infringing content, interfere with other users or systems, or reverse engineer except as permitted by law.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARVE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF AMOUNTS YOU PAID US IN THE PRIOR TWELVE MONTHS OR ONE HUNDRED DOLLARS (USD), UNLESS PROHIBITED BY LAW.

9. Indemnity

You will defend and indemnify Harve against claims arising from your use of the Services or violation of these Terms, subject to applicable law.

10. Termination

We may suspend or terminate access for violations of these Terms or operational reasons. Provisions that by their nature should survive will survive termination.

11. Governing law

These Terms are governed by the laws of the jurisdiction we designate in a future update, unless mandatory consumer protections in your country apply.

12. Changes

We may modify these Terms. We will post updates and revise the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
